I have purchased a three bedroom residential flat having an area of 1590 square feet in Gulmohar Gardens, NH-58, Raj Nagar Extn., Noor Nagar, Ghaziabad. The booking of the said flat was made in the febuary 2010 and I made every payments to SVP Builders (I) Ltd till date. At the time of booking, the Builder promised the possession of the flat by Dec\'10 and showed me a Central park as well as a very huge green area (80%), the same is also mentioned in the Brochure given to me during the time of booking. It is also mentioned in the allotment letter provided to me that if the company (SVP) fails to hand over the possession of flat completed in all respect by committed date then SVP will be liable to pay me a penalty at the rate of Rs. 3 per square feet per month for the successive delays. (Till date I have also not received my Allotment letter.)
However, the project has not been completed even after approximately 2 years from the promised date of delivery.Now builder has changed the layout of the project and going to construct two new towers in the park area and also cutting down the green area as he is coming up with another project on the same green land as Gulmohar Phase II (initially it was named Krishna Garden). When inquired, I was told by the Builder that he has an approval from Ghaziabad Development Authority (GDA). Therefore, the Central park is now converted into new buildings.
\"How can a builder change a project map without the concerned people who have already paid and bought the flat in the project?\" on the terms What he has told, Now the green area / Park which was promised me at the time of booking is gone therefore I humbly request yourself that an inquiry should be mooted and immediately the Builders encroachment should be stopped till the time matter is not clear.
